Israel Approves Death Penalty Law for Palestinians Convicted in Killing Cases

Israel has passed a highly controversial new law allowing courts to impose the death penalty in certain cases involving Palestinians convicted of killing Israelis, marking one of the most debated legal decisions in recent years.

The legislation was approved in Knesset after a final vote of 62 to 48, with lawmakers from the governing coalition supporting the measure after hours of debate.

Benjamin Netanyahu personally attended the parliamentary session and voted in favour of the bill, underlining the political significance of the decision for the current government.

The law introduces hanging as the default punishment in cases involving West Bank Palestinians convicted in killings defined as nationalistic attacks.

Under the legislation, military courts handling cases involving Palestinians in the occupied West Bank would normally issue death sentences unless judges determine exceptional reasons for imposing life imprisonment instead.

Civilian courts inside Israel may also apply the death penalty under certain conditions, but legal analysts argue that the wording of the law effectively limits its practical application mainly to Palestinians rather than Jewish Israeli citizens.

The legal definition used in the new measure focuses on killings committed with intent linked to rejecting the existence of the Israeli state, a formulation critics say creates unequal legal consequences depending on identity and political interpretation.

The law will not apply retroactively, meaning current prisoners including militants captured after the October 2023 conflict will not automatically fall under the new provisions.

Celebrations followed inside parliament after the vote, with supporters from the governing coalition describing the law as a strong security response.

Itamar Ben-Gvir, who strongly promoted the legislation, said the law sends a message that killings against Israelis will now carry the highest punishment available.

Opposition lawmakers strongly criticized the measure, arguing that allowing death sentences without unanimous judicial agreement raises major legal and moral concerns.

Human rights groups inside Israel immediately announced legal action against the law.

Association for Civil Rights in Israel submitted a petition to Israel’s highest court within hours of the parliamentary approval, arguing that the law is discriminatory and exceeds legal authority regarding West Bank residents.

Legal experts also argue that legislating directly for the West Bank raises international law questions because the territory is not internationally recognized as sovereign Israeli territory.

Several European governments had urged Israel before the vote to abandon the legislation, warning that capital punishment is viewed internationally as irreversible and lacking proven deterrent value.

Although Israel formally retains the death penalty in limited categories such as genocide and wartime espionage, the country has not carried out an execution since Adolf Eichmann in 1962.

Analysts say the law now faces a difficult legal path before practical implementation because court challenges could delay or suspend enforcement.

The debate is also expected to deepen political divisions inside Israel and increase international scrutiny over legal treatment of Palestinians under separate judicial systems.
